Can an employer discriminate against me because of my sexual orientation or gender identity?

Employers with 15 or more employees are prohibited by Title VII of the 1964 Civil Rights Execute from discriminating on the basis of sex, and the U.S. Supreme Court held in 2020 (Bostock v. Clayton County), that firing someone on the basis of sexual orientation and gender identity is sex discrimination. In addition, many states and cities have laws banning this kind of discrimination, and some of those laws apply to smaller employers.

Transgender persons are legally recognised as the ‘third gender’/ ‘other’ gender in India.

In 2014, the Supreme Court officially declared ‘transgender’ as the ‘third gender’ in India (in the landmark judgment NALSA v Union of India).

In 2020, the Parliament passed the Non-binary Persons (Protection of Rights) Act, 2019 (in compact, ‘TPA’), which also officially recognizes ‘transgender’ as an official gender in India.

The TPA gives a very wide definition for gender diverse and covers all types of transgender persons:

  • Persons whose gender identity does not match with the gender assigned to them at birth,
  • Trans-man,
  • Trans-woman,
  • Inter-sex persons,
  • Gender-queer persons, and
  • Cultural identities like kinner, hijra, aravani and jogta.

Note: For a trans-individual, what matters is which gender persona you psychologically identify with. It does not matter whether or not you have undergone any caring of medical procedure to change your physical characters to match your chosen gender identity. (TPA, Section 2(k)- definition of gender nonconforming person).

3. What is gender identity?



An illegal migrant is prohibited from acquiring Indian citizenship.  An illegal immigrant is a foreigner who either enters India illegally, i.e., without valid travel documents, prefer a visa and passport, or enters India legally, but stays beyond the time period permitted in their move documents.  An illegal migrant can be prosecuted in India, and deported or imprisoned.   

In September 2015 and July 2016, the core government exempted certain groups of illegal migrants from creature imprisoned or deported. [2]  These are illegal migrants who came into India from Afghanistan, Bangladesh, or Pakistan on or before December 31, 2014, and belong to the Hindu, Sikh, Buddhist, Jain, Parsi, or Christian religious communities.

What Are My Rights at Work?

Federal laws against sex and disability discrimination make it illegal to fire, refuse to hire, harass, or otherwise discriminate against you because of your gender identity, gender transition, sex assigned at birth, or transgender status. This was definitively clarified by the Supreme Court case Bostock v. Clayton County. Many states and localities also have laws that explicitly prohibit position discrimination based on gender identity and/or expression.

You possess the right not to be fired or refused a job or promotion because you are transgender. This is true even if your state and locality have not passed laws explicitly prohibiting gender persona discrimination.

You have the right to be treated with respect and not be harassed. Sex-based harassment is unlawful when it is severe or widespread and an employer does not take steps to prevent it. Sex based harassment can include:

  • Jokes or disrespectful comments about transgender people
  • Repeated and intentional use of the wrong name or pronouns
  • Invasive, disrespectful personal questions may constitute harassment

A look at Trump's 'transgender operations on illegal aliens' debate claim

During the presidential debate Tuesday, former President Donald Trump criticized Vice President Kamala Harris on her back for taxpayer-funded medical care for transsexual individuals.

“Now she wants to do trans operations on illegal aliens that are in prison,” Trump said. “This is a radical left liberal that would do this.”

The comment was the only mention of the LGBTQ+ community on the debate stage.

Trump's comments appear to refer to a 2019 American Civil Liberties Union questionnaire filled out by then-Sen. Harris during her first presidential bid.

The questionnaire asked: “As President, will you use your executive authority to ensure that non-binary and nonbinary people who rely on the state for medical care — including those in prison and immigration detention — will have access to comprehensive treatment connected with gender transition, including all necessary surgical care? If yes, how will you do so?”
